These Terms of Service ("Terms") govern your use of the websites, webinars, events, free resources, courses, coaching and programs offered by Rock Your Gift, LLC ("Rock Your Gift," "we," "us," or "our"). By visiting our websites, registering for an event, or purchasing or joining any program, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use our websites or services.

1. Eligibility

You must be at least 18 years old to use our services. By using them, you confirm that you are.

2. Our Services

Rock Your Gift provides educational content, live and recorded trainings, events, courses, group programs and coaching related to speaking, marketing and business growth. We may change, reschedule or discontinue any free event or resource at any time. Specific paid programs may also have their own agreement. If a program agreement conflicts with these Terms, the program agreement controls for that program.

3. No Guarantee of Results

Our content is not legal, financial, tax, medical or mental health advice. Consult a qualified professional for advice about your specific situation.

4. Purchases, Payments and Refunds

• Prices, payment plans and what is included are shown on the checkout page or in your program agreement at the time of purchase.
• If you choose a payment plan, you authorize us to charge your payment method on the agreed schedule until the full amount is paid. Choosing a payment plan does not reduce the total amount owed, even if you stop participating.
• Refunds, if any, are governed by the refund terms stated on the checkout page or in your program agreement. If no refund terms are stated, all sales are final.
• Please contact us before disputing a charge with your bank so we can help resolve the issue.

5. Events, Webinars and Recordings

Live events and webinars may be recorded. By attending, you agree that your name, image, voice and comments shared during the session may appear in the recording, which we may use for replays, training and promotion. If you do not want to appear, keep your camera off and do not speak or post in the chat.

6. Intellectual Property

All content we provide, including trainings, videos, slides, workbooks, templates, AI tools and prompts, emails, and the Rock Your Gift name and logos, is owned by Rock Your Gift or our licensors and protected by law. You may use materials you receive for your own business. You may not copy, resell, share, record, publish or create competing products from our materials without our written permission. Access to paid programs is for the purchaser only and may not be shared.

7. Your Conduct

When using our services or community spaces, you agree not to harass others, post unlawful or offensive content, spam or solicit members without permission, or interfere with our websites. We may remove content or suspend or end your access, without refund, if you violate these Terms.

8. Emails and Text Messages

By submitting your information, you agree to receive emails from Rock Your Gift about the events and resources you requested, and related content and offers. You can unsubscribe at any time using the link in any email.

If you provide your phone number and agree to receive texts, you consent to receive recurring text messages from Rock Your Gift, including event reminders, updates and offers, which may be sent using automated technology. Message frequency varies. Message and data rates may apply. Reply STOP to cancel or HELP for help. Consent is not a condition of purchase. Carriers are not liable for delayed or undelivered messages.

9. Third-Party Links and Tools

Our services may link to or use third-party websites, platforms and tools (such as Zoom, ChatGPT, Claude, Skool, or partner events). We are not responsible for their content, policies or availability. Your use of them is subject to their own terms.

10. Disclaimer of Warranties

Our websites and services are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.

11. Limitation of Liability

To the fullest extent permitted by law, Rock Your Gift and its owners, employees and contractors will not be liable for any indirect, incidental, special or consequential damages, or for lost profits or revenue, arising from your use of our websites or services. Our total liability for any claim will not exceed the amount you paid us in the twelve months before the claim.

12. Indemnification

You agree to defend and hold harmless Rock Your Gift from any claims, damages or expenses arising from your misuse of our services, your violation of these Terms, or your violation of anyone else's rights.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to conflict of law rules. Any dispute will be resolved in the state or federal courts located in San Diego County, California, and you consent to their jurisdiction. Before filing any claim, you agree to contact us first and try in good faith to resolve it informally for at least 30 days.

14. Changes to These Terms

We may update these Terms from time to time. The effective date at the top shows when they were last changed. Continuing to use our websites or services after an update means you accept the updated Terms.
